TERMS AND CONDITIONS OF USE

The “Website” or the “Service” may offer subscriptions that automatically renew. Please read these Terms and Conditions of Use carefully before starting a trial or completing a purchase for any auto-renewing subscription. To avoid being charged you must cancel a subscription or trial in time, as described in our Subscription Terms and below.
Deleting the app does not cancel your subscriptions or trials.

1. ACCEPTANCE OF TERMS

1.1. These Terms and Conditions of Use (the “Terms”) govern the relationship between you and Pafelone Limited, a company registered in Cyprus, with registered number ΗΕ 485323, and registered address Florinis 7, Greg Tower, 2nd Floor, 1065, Nicosia, Cyprus, trading as getfeels.ai or Get Feels (the “Company”, “we”, “us”, “our”), regarding your use of:

  • our websites (including getfeels.ai),

  • our mobile apps for iOS and Android (Get Feels), and

  • any other services, features, content, and products we make available
    (collectively, the “Service”).

1.2. Your access to and use of the Service constitutes your agreement to be bound by these Terms, which form a legally binding contract between you and the Company. If you do not agree to these Terms, or you are not eligible or authorized to be bound by them, you must not download the app, create an account, or otherwise access or use the Service.

which are incorporated into these Terms by reference.

1.4. We may update these Terms from time to time. Unless otherwise stated, we will indicate changes by updating the “Last updated” date at the top of this document. Where required by law or where changes are material, we will also notify you (for example via email or in-app notice). Your continued use of the Service after changes become effective means you accept the updated Terms.

2. IMPORTANT DISCLAIMERS

2.1. Nature of the Service

GetFeels is an AI-powered mental companion designed to support your emotional well-being through:

  • an AI chat companion for reflective and supportive conversation,

  • mood tracking and visual trends,

  • habit tracking linked to well-being goals,

  • a library of short mental-fitness exercises (e.g. breathing, grounding, meditation), and

  • AI-generated summaries and insights based on your entries.

The Service is intended for self-awareness, self-reflection, and mental wellness support.

2.2. No medical, mental-health, or professional advice

You acknowledge and agree that:

  • The Service does not provide medical, psychological, psychiatric, or other professional healthcare advice, diagnosis, or treatment.

  • The Service is not a substitute for professional medical or mental-health advice, diagnosis, treatment, psychotherapy, or counselling.

  • The Service must not be used for emergencies, crisis intervention, or safety-critical situations.

You must not rely on any content, conversations, insights, summaries, suggestions, or exercises provided through the Service as a basis for making medical or mental-health decisions.

If you:

  • feel unwell or in distress,

  • suspect you may have a medical or mental-health condition, or

  • are thinking about self-harm or harming others,

you must immediately contact your local emergency services, crisis hotline, or a qualified doctor, therapist, or other professional.

2.3. No harmful or violent content

The Service and its content are not intended to:

  • harm your physical or mental health;

  • encourage or support self-harm, suicidal thoughts, or suicide;

  • incite, justify, or facilitate violence, crime, or any other unlawful or harmful actions against yourself or others.

You may not use the Service to seek, share, or promote such content. We may restrict or terminate access if we reasonably believe the Service is being misused in ways that risk harm.

2.4. No guarantees or outcomes

To the maximum extent permitted by law, we make no guarantees that:

  • the Service will meet your expectations or goals,

  • the Service will improve your emotional well-being,

  • any particular results or outcomes will occur from using the Service, or

  • the information or insights provided will be accurate, complete, or suitable for your individual situation.

You are solely responsible for your decisions and actions related to your use of the Service.

3. CHANGES TO THE SERVICE

3.1. We may modify, update, suspend, or discontinue any part of the Service (including specific features, content, or availability) at any time, temporarily or permanently.

3.2. Where a change materially reduces the value of a paid subscription, we will provide reasonable notice and, where required by law, offer options such as cancelling before the change takes effect or switching to another plan.

4. ELIGIBILITY AND USER ACCOUNT

4.1. Age requirement
The Service is intended only for adults. By using the Service, you represent and warrant that you are at least 18 years old. Individuals under 18 are not permitted to use the Service.

4.2. Account registration

To use the Service (including the free tier), you must create an account and provide accurate, complete information. You agree to:

  • keep your account information up to date;

  • keep your login credentials secure;

  • not share your account or credentials with anyone;

  • notify us promptly at support@getfeels.ai if you suspect any unauthorized use of your account.

You are responsible for all activities that occur under your account.

5. LICENSE, THIRD-PARTY SERVICES, AND INTELLECTUAL PROPERTY

5.1. License to use the Service

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license (without the right to sublicense) to:

  • access and use the Service solely for your personal, non-commercial purposes; and

  • install and use our mobile apps on a compatible, non-modified device (e.g. iOS or Android device you own or control).

5.2. Third-party services and links

The Service may contain links to or integrate with third-party services, such as:

  • app stores,

  • payment processors,

  • analytics providers, or

  • other third-party sites, resources, or content.

Your use of any third-party service is governed by that third party’s terms and privacy policy. We are not responsible for third-party services or content.

5.3. Intellectual property

Except for your User Content (see Section 7), all text, images, trademarks, logos, graphics, software, data compilations, and other content of the Service are owned by or licensed to the Company.

You must not, except where permitted by law or expressly allowed in these Terms:

  • copy, modify, distribute, sell, resell, or create derivative works from the Service or its content;

  • reverse engineer, decompile, or disassemble any part of the Service;

  • remove or alter any copyright, trademark, or other proprietary notices.

Nothing in these Terms transfers to you any ownership rights in the Service or related intellectual property.

6. PAYMENTS AND REFUNDS (SUMMARY)

6.1. Paid features and platforms

Certain features of the Service are offered for a fee via auto-renewing subscriptions. You may subscribe:

  • via app stores (e.g. Apple App Store, Google Play); or

  • via the GetFeels website.

Details of subscription durations (weekly, monthly, quarterly, annual), prices, and included features are disclosed at the time of purchase and may vary by region and platform.

6.2. Automatic renewal

Unless you cancel in time, your subscription will automatically renew at the end of each billing period for the same duration and at the then-current price, and your payment method will be charged accordingly.

6.3. Refunds

  • Web purchases: If you purchase a subscription directly on our website, you may request a refund of your initial subscription payment by contacting support@getfeels.ai within 14 days of the purchase date. After 14 days, web purchases are generally non-refundable, except where required by law or where we expressly say otherwise.

  • App store purchases: Purchases made via an app store are subject to that store’s own terms and refund policy. We cannot process refunds for app store purchases; you must contact the app store directly.

7. USER REPRESENTATIONS, RESTRICTIONS, AND USER CONTENT

7.1. Your representations

By using the Service, you represent and warrant that:

  • you have the legal capacity to agree to these Terms;

  • you are at least 18 years old;

  • you will not access the Service through automated or non-human means (e.g. bots or scripts), except as expressly authorized;

  • your use of the Service will comply with all applicable laws and regulations.

7.2. Prohibited uses

You must not:

  • use the Service for any unlawful or unauthorized purpose;

  • use the Service to promote self-harm, suicide, harm to others, violence, hate, discrimination, harassment, or other harmful content;

  • use the Service to send spam, run bots, or transmit malicious code;

  • attempt to gain unauthorized access to the Service, other accounts, or our systems;

  • interfere with or disrupt the Service or its security;

  • use the Service to develop or train a competing product or service.

7.3. User Content (text only)

The Service allows you to submit textual content only, including:

  • AI chat messages,

  • mood entries and notes,

  • habit descriptions and completion logs,

  • reflections and responses to exercises, and

  • other text you input.

You are solely responsible for your User Content. You confirm that your User Content:

  • does not violate any law;

  • does not infringe third-party rights (including privacy and intellectual property);

  • does not contain personal data of others without their consent.

7.4. License to your User Content

You retain ownership of your User Content. To operate and improve the Service, you grant the Company a worldwide, non-exclusive, royalty-free license to:

  • use, host, store, process, modify, and display your User Content in connection with providing the Service (including AI processing, analytics, and summaries); and

  • create anonymised and/or aggregated data for statistical, research, and product improvement purposes.

We will process your data as described in our Privacy Policy.

8. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis, without any warranties of any kind, whether express or implied, including but not limited to:

  • fitness for a particular purpose,

  • merchantability,

  • non-infringement, or

  • accuracy, reliability, or availability.

We do not warrant that:

  • the Service will be uninterrupted, error-free, or secure;

  • defects or errors will be corrected;

  • the Service, servers, or communications are free of viruses or other harmful components;

  • any results or outcomes from using the Service will be accurate, reliable, or suitable for your specific circumstances.

Your use of the Service is at your own risk.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

9.1. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of (or inability to use) the Service.

9.2. Our total aggregate liability to you for all claims relating to the Service shall not exceed the total amount you have paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited.

10. INDEMNIFICATION

You agree to indemnify and hold harmless the Company and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • your breach of these Terms;

  • your misuse of the Service;

  • your User Content; or

  • your violation of any law or third-party rights.

11. GOVERNING LAW AND JURISDICTION

11.1. These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of Cyprus, without regard to its conflict of law rules.

11.2. Subject to any mandatory consumer protection rules that give you additional rights, any dispute arising out of or in connection with these Terms or the Service shall be subject to the non-exclusive jurisdiction of the courts of Nicosia, Cyprus, and you agree to submit to such jurisdiction.

12. MISCELLANEOUS

12.1. If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary and the remaining provisions will remain in full force and effect.

12.2. These Terms constitute the entire agreement between you and the Company regarding your use of the Service and supersede all prior agreements or understandings relating to the subject matter.

12.3. We may assign or transfer our rights and obligations under these Terms to another entity. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

12.4. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

12.5. Communications between you and us may be made electronically (for example, via the Service, email, or in-app notifications). You agree that electronic communications have the same legal effect as if they were in writing.
